Legal TABtooch · Western Australia
Terms and Conditions
These Terms and Conditions form the agreement between you and Racing and Wagering Western Australia, trading as TABtooch, covering your account and every wager you place on tabtooch.mobi. They include our betting rules, our complaints process and our promotions policy. By opening an account or placing a bet you accept them in full.
01 Who you are contracting with
TABtooch is the wagering brand and trading name under which Racing and Wagering Western Australia (ABN 21 347 055 603) operates the website tabtooch.mobi. Racing and Wagering Western Australia is a statutory authority established under the law of Western Australia. It is not a company registered with ASIC and therefore holds an ABN but no ACN. Its registered office is 114 Hasler Road, Osborne Park, Western Australia 6017, Australia.
Wagering is conducted under wagering licence number WA-BMK-2024-56301377 and is regulated by Racing, Gaming and Liquor, Department of Local Government, Sport and Cultural Industries in Western Australia, Australia. Every wagering contract is formed with Racing and Wagering Western Australia in Western Australia.
Our services are wagering on racing — thoroughbred, harness and greyhound — through the totalisator and at fixed odds, and wagering on sport at fixed odds. We do not offer any other gambling product.
02 Who may hold an account
To open and keep an account you must:
- be at least 18 years of age;
- hold the account in your own legal name, and hold only one account;
- be physically located in Australia, in a place where using an Australian-licensed wagering service is lawful;
- not be registered with BetStop, the National Self-Exclusion Register;
- not be excluded from wagering with us under a self-exclusion that is still running; and
- not be a person prohibited by a sporting or racing controlling body from betting on an event, in relation to that event.
We verify your age and identity before accepting your first bet, as required under the AML/CTF Act 2006 (Cth) and the National Consumer Protection Framework, and we may re-verify at any time.
03 Rules for using the service
You agree to use TABtooch only for your own lawful, personal wagering, to give us information that is true and current and to keep it up to date, and to check your selections and stake before confirming a bet.
You must not: allow anyone else, including a person under 18, to use your account; use automated tools, scripts or bots against the service; exploit an error in pricing or software; collude with others or with an event participant; interfere with the operation of the website; or copy or redistribute our content without written permission.
All material on tabtooch.mobi is owned by Racing and Wagering Western Australia or its licensors and is protected by copyright and other intellectual property law.
04 Your account
You are responsible for keeping your login details secure and for everything done through your account. Log out on shared devices, and tell us immediately at support@tabtooch.mobi if you suspect someone else has access.
Your account is not a bank account. We pay no interest on balances, provide no line of credit and do not lend money for wagering.
05 Suspension, restriction and closure by us
We may suspend, restrict or close an account where we reasonably suspect fraud, collusion, multiple accounts, money laundering, an integrity concern, a breach of these Terms, or where we are required to do so by law or by the regulator. We may also restrict an account where we see signs of gambling harm.
Where we do so we will tell you, unless the law prevents us. Your undisputed withdrawable balance remains yours and is returned to a verified payment method in your own name.
06 Deposits and withdrawals
We accept debit cards, PayID, BPAY and bank transfer, and Apple Pay or Google Pay when linked to a debit card. Credit cards and credit of any kind are not accepted for wagering.
Funds must come from an account in your own name. Third-party deposits are not accepted, and neither is cryptocurrency. Withdrawals are paid only to a verified payment method in your own name. Once your identity is verified we process withdrawals promptly, though your bank may take a further one to three business days. We charge no withdrawal fee.
Deposits are subject to the deposit limit you have set. See Deposit Limits.
07 Closing your account, and inactive accounts
You can close your account at any time from your account settings or by emailing support@tabtooch.mobi. No reason is required and we will not put obstacles in your way. We settle or refund open bets, return your withdrawable balance to a verified payment method in your own name, and confirm the closure in writing.
Closing an account is not the same as self-exclusion. If you want a barrier you cannot simply reverse, see Self-Exclusion.
If a withdrawal is delayed it is usually because identity verification is incomplete, the payment method is not in your name, or a source-of-funds check is outstanding. We will tell you what is needed.
If your account is inactive for 12 months we will attempt to contact you using the details we hold and will deal with any remaining balance in accordance with the applicable unclaimed money law.
08 How bets are accepted and priced
Odds are shown as decimals. Your potential return is your stake multiplied by the price and includes your stake — a $10 bet at 2.50 returns $25, of which $15 is profit.
A bet exists only once it is confirmed and appears in your betting history. Until then we may decline it or limit the stake we accept, at our discretion. The price that applies is the price confirmed at acceptance, not the price displayed when you opened the market. Once accepted, a bet cannot be cancelled or edited by you.
Markets on sport are offered before the scheduled start of the event and close at that time. Maximum payout limits may apply per customer and per day across all markets, and we may limit the stake accepted on any individual market. Where a bet would otherwise return more than the applicable maximum, the payout is capped at that maximum.
09 Betting Rules — how markets are settled
These rules govern how every market is offered and settled and form part of this agreement.
Settlement
All markets settle on the official result declared by the relevant controlling body. Where a result is later amended, bets stand on the result as it was at the time of settlement.
Errors and void bets
A bet may be declared void and the stake returned where: there is a palpable error in a price, a market or an entry; the event is abandoned or postponed and not completed within 48 hours of the scheduled start, unless a specific market rule says otherwise; or a manifest integrity breach affects the event. Where a market has already been unconditionally determined before an interruption, that market stands.
Sport — win, line and total
Win settles on the result of the fixture including any scheduled extra time, unless the market states otherwise. Line and total markets settle on the official final score. Where a market is offered on regulation time only, this is stated on the market. A change of venue may void affected markets.
Racing — tote and fixed odds
Fixed-odds racing bets settle at the price taken. Tote bets pay the declared pool dividend, which is calculated after the event from the pool and the number of winning units, and is not known in advance. Win, place and each-way bets are offered as scheduled.
A scratched runner is refunded, and deductions may be applied to fixed-odds markets on the remaining runners in line with the official rules of racing. A change of track, surface or distance may void affected markets. Dead heats are settled by dividing the stake in proportion to the number of runners dead-heating, with the balance lost.
Multis
In a multi, every leg must win and the price is the product of the legs. If a leg is void the multi is recalculated on the remaining legs. Related contingencies may be restricted, and the maximum number of legs is shown when you build the bet.
Disputes about a bet
If you disagree with how a bet has been settled, contact us within 30 days at support@tabtooch.mobi with the bet reference. Our record of the bet as accepted is the primary evidence. If we cannot resolve it, see Complaints and disputes.
10 Promotions and inducements policy
TABtooch does not offer sign-up offers, matched deposits, free or bonus bets, refer-a-friend rewards, loyalty rewards or any other inducement to open an account, to deposit, or to keep wagering. This reflects the restrictions that apply to licensed wagering operators in Western Australia and the requirements of the National Consumer Protection Framework.
Anything described on our What We Offer page is a standard product feature available to every eligible customer on identical terms, and is not conditional on depositing or betting a particular amount.
If any promotion is ever offered, its full terms — who is eligible, how long it runs, what is excluded and any conditions attached — will be published before you can take part, without advertised cash amounts and without any suggestion that wagering is a way to make money.
We may withhold, withdraw, amend or cancel any promotion, and void associated bets, where there is an error, fraud, collusion, use of multiple accounts, arbitrage against our pricing or other abuse, or where the law requires it. Customers who are self-excluded or registered with BetStop are not eligible for any promotion and receive no promotional material.
11 Advertising standards
Our marketing complies with Australian wagering advertising law, including the restrictions on gambling advertising around sports broadcasts, the AANA Wagering Advertising and Marketing Communication Code, the AANA Code of Ethics, wagering advertising regulation in Western Australia and the National Consumer Protection Framework.
We do not target people under 18 or use imagery, characters or media placement likely to appeal to them. We do not use sporting celebrities, influencers or role models to promote wagering. We do not suggest that wagering leads to financial, social or sexual success, that it is a way to recover losses or solve problems, or that skill removes the risk. Every advertisement carries an approved consumer-protection message and the 18+ mark.
Direct marketing is sent only where you have opted in, consistent with the Spam Act 2003 (Cth). Consent boxes are never pre-ticked, every message carries a working unsubscribe link, and we action opt-outs promptly. Registering with BetStop removes you from marketing by all licensed providers. Complaints about an advertisement can go to Ad Standards or to Racing, Gaming and Liquor (DLGSC).
12 Responsible gambling obligations
Setting a deposit limit is a required step when you open your account. A reduction takes effect immediately; an increase takes effect only after the applicable cooling-off period. Deposit breaks, activity statements and self-exclusion are free and available at any time.
We monitor accounts for indicators of gambling harm and may contact you, restrict activity or close an account where we consider it necessary. See our Responsible Gambling page. Gambling Help Online is free, confidential and open 24 hours a day on 1800 858 858 or at gamblinghelponline.org.au. BetStop, the National Self-Exclusion Register, is at betstop.gov.au. Lifeline is on 13 11 14.
13 AML/CTF, identity and source of funds
Racing and Wagering Western Australia is a designated service provider under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth).
Identity verification
We verify your name, date of birth and residential address before accepting your first bet, and may re-verify at any point. Most checks are electronic. Where a check does not return a match we will ask for a government-issued document such as a driver licence or passport. Until verification is complete your account may be restricted.
Source of funds
For larger or unusual activity we may ask you to evidence where your money came from — payslips, bank statements, a sale contract or similar. This is a legal obligation, not a judgement about you. Accounts may be restricted until we receive satisfactory information.
Monitoring and reporting
We monitor transactions for unusual patterns, screen against Australian sanctions lists, and lodge suspicious matter reports and threshold transaction reports with AUSTRAC as required. The law prohibits us from telling you whether a report has been made about your account.
Funds we will not accept
We do not accept deposits from a third party, cryptocurrency, or funds we believe to be the proceeds of crime, and we will not accept deposits structured to avoid detection. We retain identification and transaction records for the minimum periods required by the AML/CTF Rules, generally seven years.
14 Wagering integrity
We monitor betting for suspicious patterns and share information with sporting controlling bodies, racing stewards, integrity units and Sport Integrity Australia under information-sharing arrangements. We may suspend a market, void bets or restrict an account where an integrity concern arises.
Participants prohibited from betting on their own sport or code — players, officials, trainers, riders, connections and their associates — must not hold or use an account for those markets. Betting on the basis of inside information, arranging or attempting to arrange the outcome of an event or any part of it, and coordinating bets to manipulate a market are all prohibited.
To report corruption in racing or sport, contact Sport Integrity Australia on 13 000 27232 or at sportintegrity.gov.au, or email us in confidence at support@tabtooch.mobi.
15 Restrictions and prohibited conduct
The following will lead to account suspension or closure, voiding of affected bets, forfeiture of unlawful winnings and, where appropriate, referral to the regulator, AUSTRAC, a racing or sporting integrity body or the police:
- giving false information or using another person's identity;
- opening or operating more than one account;
- betting on behalf of, or enabling, a person under 18 or a self-excluded person;
- match-fixing, spot-fixing or betting on an event in which you are a participant or official;
- use of inside information, collusion or coordinated betting patterns;
- money laundering or terrorism financing.
16 Liability of the parties
You are responsible for the bets you place, for the accuracy of the information you give us and for the security of your account and devices.
To the extent permitted by law, Racing and Wagering Western Australia is not liable for indirect or consequential loss, for loss caused by interruption to a telecommunications service or your device, or for loss arising from your failure to keep your credentials secure. Where liability cannot be excluded, our liability is limited to the balance in your account at the time of the event giving rise to the claim.
Nothing in these Terms excludes, restricts or modifies any right or guarantee under the Australian Consumer Law that cannot lawfully be excluded.
17 No guarantee of a return
Wagering involves risk. We do not guarantee any outcome, return or profit, and over time the odds favour the operator. Form, statistics, previews and any other information we publish are general information only. They are not advice, not a prediction and not a recommendation to bet.
18 Tax
For recreational customers in Australia, wagering winnings are generally not treated as assessable income. This is general information, not tax advice, and your circumstances may differ. Racing and Wagering Western Australia meets the taxes, levies and product fees applicable to its own operations.
19 Privacy
We collect and handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. See our Privacy Policy and Cookie Policy, and direct privacy enquiries to our Privacy Officer at privacy@tabtooch.mobi.
20 Complaints and disputes
Step one — tell us. Email support@tabtooch.mobi with your account reference, the date and details of what happened, and the outcome you are looking for. We acknowledge every complaint within two business days and give you a reference number.
Step two — internal review. If our first response does not resolve it, ask for the matter to be escalated to a senior complaints officer. We aim to provide a final written response, with reasons, within 14 days. If we need longer we will tell you why and when to expect an answer.
Step three — external escalation. If you are not satisfied, or we have not responded within a reasonable time, you may take the matter to the appropriate body below at no cost. You may also contact the regulator at any time if you believe we have broken the law.

21 Changes, severability and governing law
We may amend these Terms. Material changes are published on tabtooch.mobi with a revised effective date, and where the law requires it we will notify you and seek your agreement. Continuing to use your account after a change takes effect means you accept the amended Terms.
If any provision is found unenforceable, the rest continues to apply. These Terms, together with the Privacy Policy, are the entire agreement between you and Racing and Wagering Western Australia, and are governed by the law of Western Australia, Australia. You submit to the jurisdiction of the courts of Western Australia.
